Cosmetic products marketed in Canada are primarily regulated under Health Canada’s Food and Drugs Act (FDA) and the Cosmetic Regulations.

     

     
     

    Definition of Cosmetics in Canada

    Under Canada’s Food and Drugs Act, cosmetics are classified as personal care products and are defined as substances or combinations of substances manufactured, sold, or represented for use in cleansing, improving, or altering the color, condition, or appearance of the skin, hair, or teeth, including deodorants and perfumes.

     

     
     

    The classification of cosmetic products is generally determined based on their intended use, product claims, and functional purposes. Common cosmetic categories include makeup products, skincare products, fragrances, hair care products, and nail care products.

     

    Key Regulatory Requirements for Canadian Cosmetics

    (1) Raw Material Control:Cosmetic ingredients must comply with the Cosmetic Ingredient Hotlist, which specifies prohibited and restricted substances permitted for use in cosmetics in Canada.

    (2) Label Management:Cosmetic labels must comply with Canada’s Cosmetic Labeling Requirements, including the General Cosmetic Labeling Guidelines and the Guide for Cosmetic Ingredient Labelling.

    (3) Safety Requirements:Canada’s Food and Drugs Act prohibits the sale of cosmetic products that may cause harm to human health. According to Section 23 of the Cosmetic Regulations, when Health Canada requests relevant cosmetic documentation, companies must provide safety assessment documents and supporting information.

    (4) Cosmetic Notification:Cosmetic products sold in Canada must be submitted to Health Canada through the Cosmetic Notification Form (CNF) within 10 days after the first sale of the product.

    (5) Post-Market Surveillance:Manufacturers, importers, and distributors must report adverse reactions associated with cosmetic products to Health Canada and maintain channels for receiving consumer feedback. Responsible parties must also initiate recalls when products have quality defects or present potential safety risks.
