What is EPA ?
EPA stands for the Environmental Protection Agency. It is responsible for investigating and developing national standards for a wide range of environmental programs, issuing relevant licenses on behalf of states and departments, and monitoring and strengthening consistency. Empowered by federal law, EPA regulates products that affect the environment, such as diesel engines, gasoline engines, toxic substances, pesticides, etc.
EPA Registration Background
On February 15, 2018, the US Environmental Protection Agency (EPA) reached a settlement agreement with Amazon regarding the distribution of more than 2,000 unregistered and unlabeled pesticide products between 2013 and 2016. According to the agreement, Amazon would pay an administrative penalty of USD 1,215,700 and take measures to monitor and remove illegal pesticides from the platform.
Since then, Amazon has strengthened platform supervision and investigation, identifying significant compliance risks in pesticide/pesticide device products. Starting in June 2018, Amazon began mandatorily removing non-compliant pesticide/pesticide device products from sale until they met compliance requirements and could resume selling.
In January 2019, Amazon officially introduced rules to regulate platform sellers. If a product has not obtained an EPA registration number, it is not allowed to be listed on Amazon US. Therefore, customers need to complete EPA registration in advance to prevent products from being unable to be sold
Common Regulated Devices
According to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), all devices and equipment that can sterilize, disinfect, inactivate, or trap pests (e.g., insects, mice, birds, bacteria, fungi, microorganisms, etc.) or have an effect on them must complete EPA registration before they can be sold in the US Commonly regulated device products include:

Types of Devices Not Subject to Regulation
The Federal Register notice dated November 19, 1976, regarding pest control devices and device producers also provides examples of devices not regulated under FIFRA: devices whose effectiveness depends more on the user's performance than on the device itself; and devices that trap vertebrate animals. Products that usually fall into these two categories include mouse traps, fly traps, fly swatters, cultivation equipment for weed control, and fish traps
EPA Registration Process
EPA registration must be applied for by a local US resident or company. Companies outside the US cannot apply directly. Therefore, for Chinese manufacturers like us, a US agent must be appointed. The US agent must be an individual with permanent US residence or an EPA-authorized agency.
How EPA Regulates Products
Although EPA does not require product efficacy reports, it regularly inspects product labels. Therefore, manufacturers need to design labels according to EPA requirements. In addition, EPA also requires applicants to complete the sales report for the previous year within 30 days after obtaining the registration number, and from the second year onward, the annual report must be completed before March each year
Regarding label requirements, manufacturers must apply labels for pesticidal and sterilizing products in conspicuous places such as packaging and instructions. The label must indicate that the product complies with EPA requirements and state the EPA Establishment Number. At the same time, product performance claims must be rigorous and accurate. In addition, any misleading or deceptive statements, formats, or illustrations on the product are strictly prohibited. All valid information must be clearly stated, and counterfeiting or misusing other product names is strictly prohibited
