16 CFR 1261 The promulgation of regulations
On November 25, 2022, the U.S. Consumer Product Safety Commission (CPSC) published a mandatory final rule for clothing storage units (CSUs) in the Federal Register to address the risk of death and injury associated with clothing storage unit tip-over incidents, particularly those involving children.
The final rule establishes a new consumer product safety standard for CSUs in the Code of Federal Regulations (CFR) by adding 16 CFR 1261. This section specifies minimum stability and labeling requirements (including hang tag requirements) for CSUs. The final rule also requires manufacturers of children’s CSUs to conduct testing at CPSC-accredited third-party laboratories according to 16 CFR 1261 requirements in order to obtain certification under 16 CFR 1110.
16 CFR 1261 Effective date of the regulation
The final rule became effective on May 24, 2023, and applies to clothing storage units manufactured on or after this date.The final rule also includes anti-hoarding provisions to prevent manufacturers from avoiding these requirements by increasing production or import volumes before the effective date.
16 CFR 1261 Definition of clothing storage units under the regulations
Under this regulation, a clothing storage unit (CSU) is defined as a consumer product consisting of a freestanding piece of furniture with drawers, doors, or other enclosed storage spaces that can reasonably be expected to store clothing.
The product shall meet the following criteria: a height of 27 inches or greater, a mass of 57 pounds or greater, all extendable elements filled with a load of at least 8.5 pounds per cubic foot multiplied by their functional volume (cubic feet), a total functional volume of enclosed storage spaces greater than 1.3 cubic feet, and the total functional volume of enclosed storage spaces exceeding the combined functional volume of open storage spaces and open areas.
Common categories of clothing storage units include, but are not limited to:
● Cabinet
● Dresser
● Wardrobe
● Closet
● Drawer cabinet
● Door cabinet
Whether a product is considered a clothing storage unit depends on whether it meets the definition above. Certain products may not qualify as clothing storage units due to their design, including shelving units, office furniture, restaurant furniture, laundry baskets, built-in closets, and single-compartment enclosed rigid storage cabinets.

The final rule exempts storage cabinets and portable storage lockers from the requirements.
16 CFR 1261 Regulatory requirements
The following is 16 CFR 1261 Key requirements:
1. Interlock Device Requirements
If the clothing storage unit (CSU) is equipped with an interlock device, the following requirements apply:
1) The interlock device shall be pre-installed and shall engage automatically during normal operation.
2) Since test configurations vary depending on the presence and effectiveness of interlock devices, this regulation requires interlock devices to be tested before conducting stability testing.
3) The integrity of the interlock system shall be evaluated using a horizontal pull force. If any interlocked door, drawer, or pull-out shelf can be opened without retracting the initially opened component, or if the interlock device is damaged or fails to operate as intended during the test, the interlock device shall be disabled or bypassed before conducting the stability test.
2. Stability Requirements
1) When tested on a hard, flat test surface, the overturning moment and threshold moment of the CSU shall be determined. The overturning moment shall exceed the threshold moment specified in the regulation.
2) To simulate carpeted floor conditions, the regulation recognizes that carpet surfaces may significantly affect CSU stability. Therefore, the final rule requires the use of a test block with a thickness of 0.43 inches, which causes the CSU to tilt forward by an average of 1.5°.
3) The final regulation provides two stability test methods: Test Method 1 and Test Method 2.
a) Test Method 1 shall be used for CSUs with extendable components that extend at least 6 inches from the fulcrum. To minimize testing variation, Test Method 1 shall be conducted using weights.
b) Test Method 2 shall only be used when Test Method 1 is not applicable.
3. Labeling and Tagging Requirements
The final regulation establishes requirements for warning labels, including label size, content, symbols, and format.
The warning information shall address the tip-over risks associated with CSUs and provide instructions for reducing these risks, including securing furniture to the wall, preventing children from standing on, climbing on, or hanging from furniture, avoiding tampering with interlocking mechanisms (if equipped), placing heavier items in lower drawers, and not placing televisions on CSUs unless the manufacturer specifically indicates that the product is designed for this purpose.
The requirements for label format, font, font size, and color shall comply with the referenced provisions of ASTM F2057-19.
1) The final regulation specifies requirements for the placement of warning labels, including labels applied inside drawers or doors. Warning labels shall be positioned so that they are clearly visible after the CSU has been tested according to ASTM F2057-19. The labels shall remain legible and securely attached.
2) The final regulation specifies that warning label content shall not be modified or revised unless specifically permitted by the regulation. Examples of warning labels are as follows:
3) The marking or label shall include the manufacturer’s, distributor’s, or retailer’s name and address, model number, month and year of manufacture, and a statement indicating compliance with the requirements of the final regulation.
4) The marking or label shall be visible from the rear of the fully assembled unit and shall remain clearly legible and securely attached after testing according to ASTM F2057-19.
4. Performance and Technical Data Label (Hang Tag) Requirements
The final regulation requires that performance and safety-related information be provided to the first purchaser at the time of initial purchase and with the CSU in the form of a hang tag.
1) The hang tag shall provide a stability rating ranging from 1 to “2 or more”, based on the ratio between the overturning moment and the minimum allowable overturning moment. The regulation specifies requirements for the size, content, symbols, and format of the tag. The tag shall be attached to the CSU and visible to a person standing in front of the unit.
2) The hang tag shall be attached to the product and its immediate packaging (the packaging typically provided at the point of retail sale). For ready-to-assemble (RTA) furniture, the hang tag shall be attached to the primary consumer-level packaging panel. Units shipped directly to consumers shall include the hang tag on the immediate packaging. Manufacturer and importer online sales interfaces shall provide hang tag information on the product purchase page.The following are examples of stability ratings:
5. Prohibition of Hoarding
1) The final regulation prohibits manufacturers and importers of CSUs from manufacturing or importing non-compliant products between November 25, 2022, and May 24, 2023, in quantities exceeding 105% of the average monthly production or import volume during the baseline period.
The regulation defines the baseline period as the calendar month in which the median production or import volume was calculated from the 13 months immediately preceding November 2022.
