It should be noted that the mattress recycling fee applies only to retail transactions. It does not apply to wholesale transactions, and the fee may only be collected from end users. Retailers are responsible for reporting and remitting the collected fees to the MRC.
Connecticut (CT) Scope of Application of Mattress Recycling Regulations
Products subject to the Connecticut (CT) mattress recycling fee include:

(2) Mattress foundations (including box springs)
The following products are exempt from the recycling fee (unless otherwise specified, they are outside the MRC recycling scope):

◎ Loose bedding materials (such as blankets, comforters, quilts, and sheets)
◎ Mattresses with padding components removed (partial units)
◎ Mattress pads
◎ Mattress toppers
◎ Pillows
◎ Out-of-state mattresses/foundations (where the disposer is not a Connecticut consumer or the unit was not used in Connecticut)
◎ Sleeping bags
◎ Sofa beds
◎ Water beds without upholstery materials
Compliance Obligations for Relevant Enterprises Under Connecticut (CT) Mattress Recycling Regulations
(1) Retailers
Retailers in the State of Connecticut (CT) that sell or offer mattresses or mattress foundations meeting the statutory definitions shall:
◎ Complete company registration with the MRC.
◎ Report monthly mattress sales data.
◎ Report monthly sales of mattresses and mattress foundations to the MRC and remit the corresponding recycling fees.
(2) Manufacturers and Importers
Manufacturers or importers that sell mattresses or mattress foundations meeting the statutory definitions directly to end users in Connecticut (CT) shall:
◎ Complete company registration with the MRC.
◎ If the company also directly sells or supplies products to end users in Connecticut (CT), it must register simultaneously as both a “manufacturer” and a “retailer.”
Note: The Connecticut (CT) mattress recycling fee does not apply to wholesale transactions between manufacturers/importers and retailers. Retailers shall collect the fee when selling products to end users. The fee shall only be collected from end users.
Potential Consequences of Non-Compliance with Connecticut (CT) Mattress Recycling Regulations
(1) Mattress Products Prohibited from Sale in Connecticut
Manufacturers or importers that fail to complete registration with the MRC are prohibited by law from selling mattresses and mattress foundations in Connecticut (CT).Retailers that sell products from unregistered manufacturers or importers may also be considered in violation and may be required to immediately stop sales, remove the relevant products from shelves, or terminate supply relationships.
