Instead, it has been established as a mandatory compliance requirement through legislation.Currently, several states, including California, Connecticut, Rhode Island (RI), and Oregon, have enacted mattress recycling regulations requiring relevant businesses to register with the Mattress Recycling Council (MRC) and pay a recycling fee for each applicable unit sold.

In 2013, the State of Rhode Island (RI) enacted mattress recycling legislation under Rhode Island General Laws Title 23, requiring the mattress industry to establish and operate a statewide mattress recycling system.The law explicitly requires mattress manufacturers to take responsibility for managing their products throughout their entire lifecycle. Through a unified recycling program, the legislation aims to reduce illegal dumping, reduce public costs associated with mattress disposal, and promote the development of infrastructure for mattress collection, recycling, and reuse.Rhode Island General Laws Title 23 further specifies that the U.S. Mattress Recycling Council (MRC) is responsible for administering the state’s mattress recycling program.
Rhode Island (RI) “Bye Bye Mattress” Recycling Program
In Rhode Island (RI), the mattress recycling program operated by the MRC is uniformly known as “Bye Bye Mattress.”The program covers the entire state and provides residents, businesses, and public institutions with convenient and free mattress recycling channels. A standardized recycling fee mechanism provides stable financial support for mattress collection, transportation, recycling, and proper disposal.
The program officially took effect on May 1, 2016, and currently covers nearly all municipalities throughout Rhode Island (RI). Rhode Island (RI) Mattress Recycling — Fee Rules and Cost Standards
According to Rhode Island (RI) regulations, a uniform mattress recycling fee of US$20.50 applies to all new mattresses, used mattresses, refurbished mattresses, and mattress foundations sold in Rhode Island and intended for use by purchasers within the state.The primary entities affected include:

◎ Manufacturers
◎ Importers
Retailers shall collect the mattress recycling fee from end users at the point of sale and list it separately on invoices or sales receipts as a “visible recycling fee.”The recycling fee is a fixed amount and does not vary according to mattress size, type, or construction. Each mattress and each mattress foundation is considered an independent billing unit.The recycling fee does not apply to wholesale transactions and may only be charged to end users.
Rhode Island (RI) Scope of Application of Mattress Recycling Regulations
Products subject to the Rhode Island (RI) mattress recycling fee include:
(1) Mattresses
(2) Bed foundations (including box springs)
(3) Used and refurbished mattresses or bed foundations
The following products are exempt from the recycling fee (unless otherwise specified, they are outside the recycling scope defined by the MRC):
◎ Air mattresses without upholstery materials (such as camping mattresses)
◎ Bed frames
◎ Car beds
◎ Cushions (such as cushions from chairs, sofas, or outdoor furniture)
◎ Foldable rollaway beds
◎ Futons
◎ Juvenile products, including crib and bassinet mattresses, carriages, baskets, changing tables, strollers, playpens, infant carriers, lounge pads, and crib bumpers
◎ Loose bedding materials (such as blankets, comforters, quilts, and sheets)
◎ Mattresses with padding components removed (partial units)
◎ Mattress pads
◎ Mattress toppers
◎ Out-of-state mattresses/foundations (where the disposer is not a Rhode Island consumer or the product was not used in Rhode Island)
◎ Pillows
◎ Sleeping bags
◎ Sofa beds
◎ Water beds without upholstery materials
Compliance Obligations for Relevant Enterprises Under Rhode Island (RI) Mattress Recycling Regulations
(1) Retailers
Retailers in Rhode Island (RI) that sell or offer mattresses or bed foundations meeting the statutory definitions shall:
◎ Complete company registration with the MRC.
◎ Collect the recycling fee for each mattress and bed foundation sold to end users in Rhode Island (RI), including individual consumers and contractual purchasers such as hotels, hospitals, and universities.
◎ Report monthly sales of mattresses and bed foundations to the MRC and remit the applicable recycling fees.
(2) Manufacturers and Importers
Manufacturers or importers that sell mattresses or bed foundations meeting the statutory definitions directly to end users in Rhode Island (RI) shall:
◎ Complete company registration with the MRC.
◎ If the company also directly sells or supplies products to end users in Rhode Island (RI), it must register simultaneously as both a “manufacturer” and a “retailer.”
Note: The Rhode Island (RI) mattress recycling fee does not apply to wholesale transactions between manufacturers/importers and retailers. Retailers shall collect the fee when selling products to end users. The fee shall only be collected from end users.
Potential Consequences of Non-Compliance with Rhode Island (RI) Mattress Recycling Regulations
Failure to comply with Rhode Island mattress recycling regulations (Rhode Island General Laws Chapter 23-90) may result in the following compliance risks:
(1) Prohibition of Product Sales in Rhode Island (RI)
Manufacturers and importers that fail to register with the MRC may not legally sell mattresses or mattress foundations in Rhode Island (RI).Retailers that sell products from unregistered entities may also be considered in violation and may be required to immediately remove such products from shelves or discontinue sales.
(2) Civil Monetary Penalties
Rhode Island (RI) regulations establish specific penalties for violations. A first violation may result in a civil fine of up to US$1,000. For second and subsequent violations, the maximum civil penalty may reach US$5,000 per violation.
(3) Recovery of Unpaid Fees and Retroactive Payments
Companies that fail to collect mattress recycling fees as required by law or fail to remit collected fees to the MRC on time may be required to pay outstanding amounts retroactively and bear related compliance remediation costs.
(4) Restrictions on Sales Channels and Platform Access
As environmental compliance requirements become increasingly strict, more retailers, e-commerce platforms, and institutional purchasers require MRC registration and compliance status as prerequisites for cooperation.Companies unable to provide valid proof of compliance may face restrictions on product listings, termination of partnerships, or loss of procurement opportunities.
