    The Title XXI - COVID-19 Regulatory Relief and Work-From-Home Safety Act recognizes California Technical Bulletin TB 117-2013 as a federal requirement applicable to upholstered furniture products in the United States.

    This requirement has been incorporated into 16 CFR Part 1640 and is administered by the U.S. Consumer Product Safety Commission (CPSC).

    According to this regulation, upholstered furniture products shall meet the following requirements:

    1.Comply with the flammability requirements specified in California Technical Bulletin 117-2013.
    2.Include a permanent certification label and a compliance statement.

     

    Product Range

    16 CFR 1640.3 defines the regulated term “upholstered furniture”, which includes the following products:

    Upholstered products intended for indoor use

    Removable or fixed upholstered products

    Products containing padded seats, backrests, or armrests

    Padding, stuffing materials, and articles sold as part of furniture

    Children’s furniture containing upholstered components

     

     

    The following products are excluded from the scope of 16 CFR Part 1640:

    Mattresses

    Foundations

    Bedding products

    Furniture intended for sports, fitness, and exercise activities

    Outdoor upholstered furniture

    In addition, this regulation excludes soft upholstered products regulated under 16 CFR Parts 1632 and 1633.

    Examples of products regulated under 16 CFR Parts 1632 and 1633 include:

    Baby carriers

    Car mattresses

    Carriage cushions

    Basket liners

    Leisure mats

    Dressing table pads

    Stroller mats

    Crib bumpers

    Baby mattresses

    Sleeping bags

     

    Certification Label Requirements

    16 CFR 1640.4 specifies certification labeling requirements for regulated upholstered furniture products.

    All applicable upholstered furniture products shall bear a permanent label containing the following statement:

    “Complies with U.S. CPSC requirements for upholstered furniture flammability.”

    This statement certifies that the upholstered article complies with the flammability requirements of California Technical Bulletin 117-2013.

     

    Certification Label Statement Requirements

    The certification label statement shall meet the following requirements:

    Appear on the front of the label and be written in English.

    Be prominent and clearly legible.

    Have a minimum text height of 1/8 inch.

    Not be smaller than any other text appearing on the label.

    Be printed in black text on a white background and surrounded by a black border.
